Who gets what: Class 1: Married/Civil Partnership/Common Law Relationship Survivors

 

Question

Common Law relationship: Do you live with another?

Answer

YES: I cohabit - we live as Common Law Partners

Result

Common Law partner gets nothing, but may be able to apply to the Court for provision as a dependant person.

 

Question

Are you married or have you entered into a formal same-sex civil partnership and have no children?

Answer

YES: I am married/have a formal same-sex civil partnership. I have no children.

Result

Your spouse inherits all your estate.

 

Question

Are you married or have you entered into a formal same-sex civil partnership and have children?

Answer

YES: I am married/have a formal same-sex civil partnership. I have surviving children.

Result

Your spouse inherits your personal belongings (chattels), plus 1st £250,000* plus half your residuary estate.

*July 2014: Government has introduced a mechanism for the £250,000 fixed sum to increase, once consumer prices index has increased by 15%.

 

Who gets what: Class 2: Surviving Children

 

Question

Do you have children and are you married?

Answer

YES: I am married and have surviving children

Result

Your children inherit your estate, excluding your chattels, the 1st £250,000* and the first half of the remainder (see your spouses entitlement above)

 

Question

Do you have children but are NOT married?

Answer

YES:I am single and have surviving children.

Result

Your children inherit everything in equal measures.**

*July 2014: Government has introduced a mechanism for the £250,000 fixed sum to increase, once consumer prices index has increased by 15%.

**Law puts your children's share in trust until they are 18 years old. It is possible to delay this if you specify otherwise via a trust within a valid Will.

Without a Will your children's Guardians and Trustees will be appointed by the Court.

 

Who gets what: Other classes if you are single and without a surviving spouse or partner or children

 

Class 3   

Your surviving parents inherit in equal shares providing there are no class 1 (Spouse) or class 2 (Children) survivors as in A and B above.

 

Class 4   

Your surviving brothers and sisters inherit in equal shares provided there are no class 1, 2 or 3 survivors.

 

Class 5   

Your surviving half-brothers and half-sisters inherit in equal shares provided there are no class 1, 2, 3 or 4 survivors.

 

Class 6   

Your surviving grandparents inherit in equal shares if there are no class 1, 2, 3, 4 or 5 survivors.

 

Class 7   

Your surviving uncles and aunts inherit in equal shares if there are no class 1, 2, 3, 4, 5 or 6 survivors.

 

If there no survivors in the seven classes listed , your estate passes to the Crown.
